Is cannabis legal in Tanzania?

Cannabis is illegal in Tanzania.

Simple possession of cannabis can result in up to five years imprisonment, with additional fines, according to the Drug Control and Enforcement Act. Despite this, Tanzania records widespread cannabis use and is said to have the highest number of cannabis smokers in East Africa.

Since 2012, lawmakers have been campaigning to make the penalties for selling cannabis more severe, with life sentences in place for serious drug offences.

Although the laws are strict, the country is one of the world's largest cannabis producers. A result of cannabis being more lucrative to grow than other crops.

The regions where cannabis cultivation is most common are Morogoro, Arusha, Tanga, Mara, Kagera, and Ruvuma.

Along with supplying a considerable domestic market, Tanzania plays a role as a supplier of cannabis to neighbouring countries. Corrupt practices among officials contribute to the ubiquity of the cannabis market in Sudan.

Though cannabis cultivation is prevalent, the government shows no signs of softening its approach toward the plant. In August 2020, they pledged to work with law enforcers to eradicate cannabis farming, with the leader of the Tanzania Forest Service Agency commenting: “Cannabis is a drug that poses a health risk to users, and cultivating the drug in our forests is illegal.”

Legislation

The Drug Control and Enforcement Act (CAP. 95 R.E. 2019).

The Tanzania Food, Drugs and Cosmetics Act (CAP. 219).

Possession or use is punishable with 1-5 years of imprisonment, or a hefty fine for small amounts.

Small quantities are classified as follows:

  • cannabis plant < 50g
  • cannabis resin or oil < 5g

The onus falls on the individual to prove intent not being for sale or distribution for larger quantities.

Engagement in cultivation (which includes gathering) is liable to imprisonment of not < 30 years.

Related activities may be conducted only on the account of government.
