Is cannabis legal in Gambia?

Cannabis is illegal in Gambia.

The cannabis trade is significant, and cannabis is the most commonly seized drug in the country.

While most cannabis originates from the Casamance region in Senegal and Sierra Leone, it also grows naturally within The Gambia, making it easily accessible.

The government opposes the decriminalization of cannabis and confiscates more than a metric ton of marijuana annually. The COVID-19 pandemic led to an increase in cannabis production and informal sector sales as people sought income opportunities. Individuals of all ages are involved in the cannabis trade and have been arrested for possession.

In 2019, Gambian authorities denied decriminalization or any regulations that would lessen their staunch opposition.

Legislation

In 2003, Gambia's government passed The Drug Control Act.

The country also established the Drug Law Enforcement Agency (DLEAG) - a former unit within the Gambian police - in 2005 to advise the state on drug abuse policies and enforce the Drug Control Act.

Government plans are underway to integrate treatment programs into the existing legislation.

Drug Control (Amendment) Act 2014, Section 35, in relation to first-time offenders offers leniency according to amount:

  • 0.1 - 150g: fine and/or imprisonment of between 6 months and 1 year
  • 151 - 500g: fine and/or imprisonment of between one and 2 years
  • above 500g: fine and/or imprisonment of between 2 and 3 years
